这几天把Bar Evaluation的网申填了 碰到了些许问题 和同志们进行了讨论 但还是觉得不保险 于是今晚也打了电话给BOLE的办公室 趁记忆还算清晰 把相关流程和可能碰到的问题提一下 希望对大家有帮助：

这是相关规定的网址 其中Required Documents里提及到了需要准备的材料

II. LIST OF REQUIRED DOCUMENTATION

A. Rule 520.6(b)(1) applicants (i.e., MOST foreign-educated applicants):

1. Official Transcript(s). Submit a final, official transcript directly from every law school attended that includes the dates of attendance for each period of study, the courses taken and passed for each period of study, the grades, the number of hours of classroom attendance, the degree awarded, and the date the degree was awarded.

2. Degree Certificate. If the official transcript does not clearly state the degree awarded and/or the date such degree was awarded, you must also furnish the degree certificate.

3. Proof of fulfillment of the educational requirements for admission to the practice of law in the foreign country. a. If you are admitted to practice law in a foreign country, attach a copy of your admission certificate, OR b. If you are not admitted to practice law in a foreign country, submit proof of the educational requirements for admission to practice law in your country and proof from the bar admission authorities that you have fulfilled these requirements.

4. Accreditation. Submit a written statement from the competent accrediting agency of your foreign government that the law school or schools you attended were recognized by them as qualified and approved throughout your period of study. The Board maintains a list of law schools from which we have received proof of accreditation. The confirmation email that you received upon submission of your Request for Evaluation Form will indicate whether or not you are required to provide proof of Accreditation.

5. LL.M. Certificate of Attendance Form & Official LLM Transcript. Applicants relying on the cure provision must request their U.S. law school to submit the completed LL.M. Certificate of Attendance Form and an Official Transcript directly to the Board office upon graduation.

Upon submission of each of the above listed documents the Board will send you an email confirming receipt of the document. If you do not receive emails confirming the Board's receipt of each of the above listed documents you should contact the Board regarding the status of your file. It is the sole responsibility of the applicant to confirm that all of the documentation is submitted to the Board. The Board will not contact you to remind you to submit missing documents.

English translation. If the law school transcripts, degree certificate, or any of the other documentation requested above are not in English, you must also furnish English translations of the documents prepared by an official translator. Translations made by the applicant will not be accepted. Translations may be mailed to the Board under separate cover and need not come directly from the issuing school or university. If you do not have a copy of the transcript from which to produce an English translation, then you should order a second original from your school – one to be sent directly to the Board, and one to yourself – to be used as a reference for the English translation.

10月1日是ddl 并且由于evaluation的效率很低 可能要六个月 最下面有一个Online Foreign Evaluation的连接：

选Create New BOLE Account 进入 https://www.nybarapply.org/feval/NewAccount.aspx 注册之后他们会发一封自动邮件到你的邮箱 然后你用初始密码登陆以后 会让你改密码，给你BOLE ID和Evaluation ID 号称这两个ID很重要 因此我就自己给自己发了一封邮件 以做记录

然后按照他们的要求填相关的申请表格，大致内容包括：1. 填写身份信息 2. 联系方式 3. 在中国上的各个法学院的信息（其中会问是否每个学期都有attendance的要求，我选了Yes 是不是远程教育什么的，我选了No）4. 是否在美国以外的地区执业 5. 目前是否已经完成了Cure条款要求的法学院教育或者已经enroll，我选了No，因此美国法学院名称、项目名称、毕业时间/预计毕业时间等都不需要填写，选Yes的话需要填写。

问题1：上述第5点的本意是希望你被法学院录取，以便符合Cure条款的要求，如果我在enroll以后填写，那么完全没有问题，但我又担心等到7、8月份再填写审核时间6个月岂不是太晚了，但现在填写我又必须要填No，填No要不要紧

我电话咨询了BOLE，答复是：用电话或者传真告诉他们你的BOLE账号，以及你录取的学校、项目以及预计毕业时间。他们今天就问我要了，我说我暂时没决定去哪里，他们让我之后提供。可见并非一定要等到入学以后才可以告诉他们，我理解大家决定了就知会他们吧。

在注册完毕以后，BOLE会发一份自动邮件出来，其中附件是告诉我们需要提交哪些文件，这些东西本帖上述第一个链接中就提及了，没什么不同。

1. Official Transcript(s). 这两样东西应届生可能暂时无法提供吧 所以你们要等到毕业以后吧

唯一在邮件中有价值的信息是：

Accreditation Statement: Please note that the Board maintains a list of law schools from which we have received proof of accreditation. Your law school is currently on the list of accredited schools the Board has on file.  Therefore, you will NOT need to provide proof of accreditation as part of the required supporting documentation you must submit.

之前有版友问过我有没有这种“豁免Accreditation的名单”，很抱歉我没有，听说只要在填写Online Evaluation Application的时候下拉菜单里有的学校都是被豁免的，但我无法验证，有待大家自己进一步验证了。

在提交文件中，会发现之前在版面上就已经讨论争议最大的就是 Proof of fulfillment of the educational requirements for admission to the practice of law in the foreign country.

a. If you are admitted to practice law in a foreign country, attach a copy of your admission certificate, or

b. If you are not admitted to practice law in a foreign country, submit proof of the educational requirements for admission to practice law in your country and proof from the bar admission authorities that you have fulfilled these requirements.

问题2：我们国家司法部、司法局怎么可能为没有在中国执业的同志们出具文件，证明你们已经符合了考bar的Educational Requirements？

同样在电话咨询中我说我们的authority不出具这样的文件，BOLE今天给我的答复是“你什么学校的，报给我听”我报了，她查询片刻后说，如果你们的authority不出具这样的文件，你这个学校是可以出具相应的证明文件的。至于你们所在大学是否有这样的资格，我没法一一咨询，如果你们不放心可以电话去问问。

此外，邮件中还特别提及了：Please note that the documentation must consist of originals or copies certified directly by the issuing institution. (Faxed copies, photocopies certified by a notary public, and photocopies certified by anyone other than an official at the issuing institution are NOT acceptable). All documents submitted become the property of the Board and will not be returned.  You will receive an email confirming receipt of any document received in support of your evaluation.

问题3：司法部或者司法局怎么可能证明我的资格证复印件？那我公证到底行不行？

在电话咨询中，我继续鄙视我们的authority 不出具该等文件，BOLE今天给我答复是：如果你能说明理由，说明你们的政府机关不出这样的文件，那么公证文件也是可以的。至少根据今天的答复，大家去公证资格证和/或律师证看来没有问题。

听西北群里的小伙伴问之前的同学，他们说最后BOLE会审核的蛮松的，而且去年就要求说不接受公证，但实际上还是接受的。但历来，电话咨询和道听途说都是需要留一个disclaimer的，这个东西毕竟不是白纸黑字写下来的，电话咨询的效力到底有多大，道听途说的过去的实践能否继续适用于今年，我也不能打包票。

以上即是最近填写Evaluation 网申及材料准备过程中碰到的几个问题，以及电话咨询后的结果，仅供同志们参考。
